Digital Millennium Copyright Act (DMCA) Notice and Policy

Career Hunter respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998, the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, Career Hunter will respond expeditiously to claims of copyright infringement committed using the Career Hunter website or other online network accessible through a mobile device or other type of device (the “Sites”) that are reported to Career Hunter’s Designated Copyright Agent, identified in the sample notice below.

DMCA Notice of Alleged Infringement (“Notice”)

  1. Identify the copyrighted work that you claim has been infringed, or – if multiple copyrighted works are covered by this Notice – you may provide a representative list of the copyrighted works that you claim have been infringed.
  2. Identify the material that you claim is infringing (or to be the subject of infringing activity) and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material, including at a minimum, if applicable, the URL of the link shown on the Site(s) where such material may be found.
  3. Provide your mailing address, telephone number, and, if available, email address.
  4. Include both of the following statements in the body of the Notice:
  • “I hereby state that I have a good faith belief that the disputed use of the copyrighted material is not authorized by the copyright owner, its agent, or the law (e.g., as a fair use).”
  • “I hereby state that the information in this Notice is accurate and, under penalty of perjury, that I am the owner, or authorized to act on behalf of the owner, of the copyright or of an exclusive right under the copyright that is allegedly infringed.”

DMCA Takedown Process

Upon receipt of a compliant DMCA Notice as described above, Career Hunter will:

  1. Remove or disable access to the infringing material;
  2. Notify the content provider, member or user that it has removed or disabled access to the material; and
  3. Terminate repeat infringers’ access to the Sites.

Counter-Notice

If you believe that the material you posted on the Site was removed or access to it was disabled by mistake or misidentification, you may file a counter-notice with us (a “Counter-Notice”) by submitting written notification to our copyright agent (identified above). The Counter-Notice must include substantially the following:

  1. Your physical or electronic signature;
  2. An identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access disabled;
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled;
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which the address is located, or if your address is outside of the United States, for any judicial district in which Career Hunter may be found, and that you will accept service of process from the person who provided notification of the alleged infringement.

If a Counter-Notice is received by the Copyright Agent, Career Hunter may, in its discretion, send a copy of the Counter-Notice to the original complaining party informing that person that Career Hunter may replace the removed material or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the content provider, member or user, the removed material may be replaced or access to it restored in 10 to 14 business days or more after receipt of the Counter-Notice, at Career Hunter’s discretion.

Repeat Infringer Policy

In accordance with the DMCA and other applicable law, Career Hunter has adopted a policy of terminating, in appropriate circumstances and at Career Hunter’s sole discretion, subscribers or account holders who are deemed to be repeat infringers. Career Hunter may also at its sole discretion limit access to the Site and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

Changes to This Policy

Career Hunter reserves the right to update or modify this DMCA Policy at any time and from time to time without prior notice. Please review this policy periodically, and especially before you provide any information through the Site. This DMCA Policy was last updated on the date indicated above. Your continued use of the Site after any changes or revisions to this DMCA Policy shall indicate your agreement with the terms of such revised DMCA Policy.
